These Terms & Conditions (“Terms”, “Terms and Conditions”) govern the use of the mobile application VELVET, the website velvet-meet.com, and all related features, content, digital products, in-app purchases, community areas, support channels, and help pages (collectively, the “Service”).

By downloading the app, accessing the website, creating an account, or using any part of the Service, you explicitly confirm that you have read, understood, and fully agreed to these Terms, the Privacy Policy, and the Community Rules.

If you do not agree with these Terms, you are strictly prohibited from using VELVET.

1. Operator, Scope, and Contractual Relationship

VELVET is operated by an entity based in Switzerland.
The exact legal company name, address, and registration details will be added to the imprint at a later stage.

These Terms apply to:

• the VELVET mobile application (iOS and Android),

• the website velvet-meet.com,

• all features including Profiles, Explore, Map & List View, Friends, Chats, Groups, Velvetvibe (Pins),

• all free and paid functionalities (including Boosts, Ghost Mode, Pins, and future products),

• all moderation, safety, reporting, and support processes.

By using the Service, a legally binding user relationship is established between you and VELVET.

2. Changes to These Terms

VELVET reserves the right to modify, update, amend, or replace these Terms at any time and at its sole discretion. Such changes may be required due to legal obligations, security updates, technical changes, new features, business decisions, or app store requirements.

The most current version published on the website or within the app shall always apply.
Your continued use of the Service after changes take effect constitutes your full and unconditional acceptance of the revised Terms.

3. Age Restriction – 18+ Only

VELVET is strictly intended for individuals who are at least 18 years old.

By using the Service, you represent and warrant that:

• you are at least 18 years of age,

• you do not provide false age information,

• you are not acting on behalf of or in the interest of a minor.

VELVET does not perform continuous age verification but reserves the right to request additional proof, restrict functionality, suspend, or permanently delete accounts if age or identity is in doubt.

Zero tolerance applies to any content or behavior involving minors, including but not limited to:

• grooming,

• sexual exploitation,

• child sexual abuse material (CSAM),

• any sexualized interaction involving minors.

Such violations result in immediate and permanent account termination and may be reported to competent authorities where legally required or permitted.

4. Registration, Login, and Account Responsibility

VELVET uses a password-free login system. Access is provided via:

• a linked Google account, or

• a phone number using SMS-based login verification.

You are solely responsible for securing your device and login credentials.
VELVET assumes no liability for damages resulting from unauthorized account access.

If you suspect unauthorized use, you must contact support immediately.

VELVET reserves the right to suspend or permanently delete accounts at any time, including but not limited to cases of:

• violations of these Terms or Community Rules,

• abuse, fraud, or manipulation,

• security risks,

• doubts regarding identity or age.

Account termination may occur without prior notice.
There is no entitlement to restoration, content recovery, or refunds.

5. Nature and Purpose of VELVET

VELVET is an open social and connection platform.
It is neither exclusively a dating app nor exclusively a social network.

Users may use VELVET to:

• meet new people,

• build friendships,

• pursue dating or casual connections,

• participate in groups,

• connect based on shared interests.

VELVET does not guarantee any matches, responses, meetings, compatibility, or outcomes.
All interactions are voluntary and conducted at your own risk.

6. Conduct, Responsibility, and Safety

You agree to behave respectfully, lawfully, and responsibly at all times.

Prohibited behavior includes, but is not limited to:

• harassment, bullying, threats, stalking,

• hate speech, discrimination, or incitement of violence,

• fraud, scams, impersonation,

• sharing private information of others without consent,

• non-consensual sharing of intimate content,

• any illegal activities or content.

VELVET may remove content, restrict features, or terminate accounts whenever necessary to protect users or the integrity of the Service.

7. User Generated Content (UGC)

Users may create and share content, including text, images, messages, group posts, pins, and comments.

You retain ownership of your content but grant VELVET a worldwide, non-exclusive, royalty-free license to store, process, display, and distribute such content for the operation of the Service.

VELVET is not obligated to pre-screen content but reserves the right to remove or restrict content at its discretion.

8. Virtual Goods, In-App Purchases, and Pricing Changes

VELVET offers digital features (“virtual goods”), including Boosts, Pins, and Ghost Mode.

Virtual goods:

• have no real-world monetary value,

• are non-transferable,

• cannot be redeemed for cash,

• exist solely within the Service.

ALL PURCHASES ARE FINAL AND NON-REFUNDABLE.

By purchasing virtual goods, you acknowledge that:

• the service begins immediately,

• no right of withdrawal applies,

• no refunds or compensation are provided under any circumstances, including:

  • account deletion,

  • account suspension,

  • non-use,

  • accidental purchase,

  • change of mind.

VELVET expressly reserves the right to change prices, packages, availability, and features at any time without obligation or compensation.

9. Location Data, Visibility, and Ghost Mode

VELVET uses location information only within the app’s functional logic. Exact addresses are never displayed.

Ghost Mode allows users to hide their profile from Explore and Map/List View displays.
Ghost Mode does not prevent visibility when users voluntarily share content, post pins, or participate in groups.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available.”

VELVET makes no warranties regarding:

• user behavior,

• user content,

• real-life interactions,

• uninterrupted availability,

• error-free operation.

11. Limitation of Liability

To the maximum extent permitted by law, VELVET is liable only for intentional misconduct and gross negligence.
Liability for indirect, incidental, consequential, or immaterial damages is excluded.

12. Governing Law and Jurisdiction

These Terms are governed exclusively by Swiss law, excluding conflict-of-law principles.
The place of jurisdiction is the operator’s registered seat in Switzerland, where legally permissible.
